
Whataburger is Facing a Six-Figure Lawsuit Over Onions in Texas
We live in a great country and the great state of Texas. Let's face it, we are blessed with so many things and so many freedoms. One of those freedoms is the capability to sue. That's right, sue people, and people are suing in today's world. You can sue for just about anything these days, and boy, are people taking advantage of this privilege.
Have you ever felt victimized by a fast food restaurant after they charged you for extra cheese and pickles and didn't give you extra cheese and pickles? Did they put tomatoes on your burger when you specifically asked for no tomatoes because you loathe those rounded circles of seeds? Trust me, I sympathize.
Houston Man is Suing Whataburger for Putting Onions in His Meal
You read that right, a Houston man is doing what we all want to do when we get something we hate on our burger. He is suing a fast food restaurant for putting onions on his hamburger.
Why is a Houston Man Suing Whataburger over Onions?
Now, before you start thinking that this is a frivolous lawsuit. It's not. Demery Ardell Wilson is suing Whataburger in Harris County because after the restaurant put onions on his hamburger after he asked for the meal with no onions, he "sustained serious personal injuries for which he had to see the care of medical professionals." In other words, Wilson is allergic to onions, and he had an allergic reaction.
You may be saying, "why didn't he check the burger before he ate it, and if you're that allergic to something, don't eat out.
Those comments are all fine and dandy, but you have to realize that people of all kinds with all kinds of ailments still like to grab some fast food, and when you ask for something to be left off your food, you expect it.

Plus, if you unexpectedly have to go to the hospital for medical treatment, it's expensive even with insurance, and if you don't have insurance, that can devastate you financially, so it makes sense that a person would like to recoup that money.
Lawsuit Seeks Up to $1 Million from Whataburger
According to Houston Public Media, Wilson is asking for between $250,000 and $1 million because Whataburger "failed to act appropriately and reasonably should have known of the danger of their actions."
Whataburger responded that Wilson "failed to use caution as would have been used by a reasonable person under similar circumstances."
I wasn't there when he ate the burger, but I'm sure that he did check it. But sometimes there is a rogue onion on a burger you miss. Those onions are sneaky.
People are human and make mistakes, and I'm sure the rogue onions weren't put on the burger on purpose, but at the same time, paying attention while you are doing your job and making sure an order is correct is also part of your job if you are assembling burgers. Once that no onion sticker goes onto a package, it probably should have no onions.
Whataburger Isn’t the Only Restaurant He’s Sued
This isn't the first time Wilson has sued a fast food restaurant. According to CBS Austin, Wilson has recently sued Sonic Drive-In as well over a similar situation.

This is not Wilson’s first legal dispute involving a fast-food restaurant. In May 2024, he filed a similar suit against Sonic Drive-In, which was dismissed the following month.
